Terms of Service
These Terms of Service (the "Terms") are an agreement between you and Restock Time (the "Service"). By creating an account, confirming a watch, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
Eligibility
You must be at least 18 years old, or the age of majority where you live, to create an account or use the Service. By using Restock Time, you confirm that you meet this requirement and that the information you give us is accurate.
What Restock Time Does
Restock Time is a product availability alert service. You paste a link to a product at a supported retailer and choose the variant you care about, such as a specific color and size. We check that listing on a recurring schedule and notify you when it appears to be available again. How often we check and how many watches you can run at once depend on your plan. You can see current limits on the pricing page.
No Guarantee of Availability
Restock Time is a head start, not a guarantee. Our alerts are based on availability signals we detect at supported retailers, and those signals can be incomplete, delayed, or wrong. An alert does not mean a product is still available when you visit the retailer, and it does not reserve, hold, or buy anything for you. High-demand items can sell out in the time between when we detect availability and when you act. We also can't promise that we will catch every restock, that checks will happen at any exact moment, or that notifications will always arrive without delay. Please treat each alert as a prompt to check the retailer yourself.
Your Account
You are responsible for activity on your account and for keeping access to your email secure, since we sign you in using one-time codes sent to your email address. Please give us an email address you control and keep it up to date, and tell us promptly if you think someone else has gained access to your account. Accounts are for individual use. Deleting your account disables all of your watches and alerts.
Acceptable Use
We want Restock Time to stay reliable and fair for everyone, so please use it responsibly. You agree not to:
- create accounts in bulk, use disposable or other people's email addresses to get around limits, or otherwise abuse our signup or free plan;
- resell, redistribute, or commercially exploit the Service or its alerts without our permission;
- access the Service through automated means, scrape it, or place unreasonable load on our systems;
- interfere with, probe, or try to defeat the security of the Service; or
- use the Service for anything unlawful or to infringe anyone's rights.
We may limit, suspend, or remove access that we reasonably believe breaks these rules or harms the Service, other users, or the retailers we monitor.
Plans, Billing, and Cancellation
Restock Time offers a free plan and paid plans. Current plans, prices, billing periods, and what each one includes are shown on the pricing page. Paid plans are subscriptions: unless you cancel, they renew automatically at the end of each billing period, and the payment method you provide is charged through our third-party payment processor. We don't store your full card details ourselves.
You can cancel anytime from your account. When you cancel, your paid features stay active through the end of the period you've already paid for, and your plan then returns to free. Except where the law requires otherwise, payments are non-refundable and we don't pro-rate partial periods. If you move to a plan with a lower watch limit, watches above that limit may be paused to fit the new plan. We may change prices or what a plan includes, and we'll give you reasonable notice of changes that affect an active paid plan before they apply to your next renewal.
Watches and Monitoring Windows
Each watch runs for a limited monitoring window that depends on your plan, after which it expires and stops checking. We'll usually let you know before a watch is about to expire so you can renew it. We may also pause or stop watching a listing if a retailer becomes unavailable to us, if a link stops working, or if continuing would strain the Service or a retailer.
Third-Party Retailers and Links
Restock Time is not affiliated with, endorsed by, or sponsored by the retailers we monitor, and their names and trademarks belong to them. We don't sell the products you watch and we're not part of any purchase you make. When you buy from a retailer, that retailer's own terms, pricing, and policies apply, and any issue with an order is between you and them. Some links we send may be affiliate links, which means we might earn a small commission if you buy, at no extra cost to you. This never changes which restocks we tell you about.
Email Alerts and Communications
When you use Restock Time, we send you account emails (such as sign-in codes) and the restock alerts you set up. You can stop a watch's alerts using the unsubscribe link in those emails or by editing or deleting the watch. We may still send essential account and transactional messages while your account is open.
Changes to the Service
Restock Time is still growing, and we may add, change, pause, or remove features, supported retailers, or limits over time. We may also need to interrupt the Service for maintenance or for reasons outside our control. We'll try to avoid disruption where we reasonably can.
Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We don't warrant that the Service will be uninterrupted, timely, secure, or error-free, or that the availability information we provide will be accurate or complete. Some jurisdictions don't allow certain warranty exclusions, so some of these may not apply to you.
Limitation of Liability
To the fullest extent permitted by law, neither Restock Time, nor our affiliates, employees, or service providers will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost opportunities, or missed purchases, arising out of or relating to your use of (or inability to use) the Service, even if we've been advised that such damages are possible. To the extent we are found liable, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or five US dollars. Some jurisdictions don't allow some of these limits, so parts of this section may not apply to you.
Termination
You can stop using Restock Time at any time and delete your account from your account settings. We may suspend or end your access if you breach these Terms, if we're required to by law, or if we reasonably need to protect the Service, other users, or the retailers we monitor. When access ends, your watches and alerts stop, and the parts of these Terms that by their nature should continue (such as the disclaimers, liability limits, and governing law) will remain in effect.
Changes to These Terms
We may update these Terms from time to time. When we do, we'll change the date above, and for material changes we'll give reasonable notice, such as by email or a notice in the Service. If you keep using Restock Time after an update takes effect, you're agreeing to the updated Terms. If you don't agree, please stop using the Service and delete your account.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and Restock Time agree that the state and federal courts located in Santa Clara County, California will have exclusive jurisdiction over any dispute relating to these Terms or the Service, except where the law gives you the right to bring a claim somewhere else, such as the courts where you live. Nothing in this section takes away any consumer-protection rights you have under the laws of the place where you live that cannot be waived by agreement.
